On January 5, 2018, our firm filed a lawsuit against Rehab Synergies, LLC alleging the healthcare company violated the federal Fair Labor Standards Act (FLSA) by failing to pay its therapists in Skilled Nursing Facilities (SNFs) proper overtime pay. The complaint was filed in federal court in the Southern District of Texas Case No. 7:18-cv-00004.
The complaint alleges that company mandated productivity requirements compel therapists to work off the clock in order to boost their productivity score. Examples include working through an unpaid meal break, clocking out but remaining at work, or taking work home to finish off the clock. According to the lawsuit, these therapists are due overtime pay for this off the clock work. It should be noted that the allegations in the complaint have yet to be proven, and the company is entitled to assert defenses including denying the allegations.
