Mobile Phlebotomists Bring Collective Action against Stover Diagnostics to Recover Unpaid Wages

Barrett Johnston Martin & Garrison, along with Gilbert McWherther Scott Bobbitt, PLC, has filed a collective action lawsuit against Stover Diagnostics Laboratories, Inc. seeking minimum and overtime wages for mobile phlebotomists.

 

The lawsuit alleges that Stover Diagnostics’ mobile phlebotomists routinely work over 40 hours per week traveling hundreds of miles to patients’ homes or nursing facilities to draw blood and take other samples for laboratory testing. However, the Plaintiffs allege that Stover Diagnostics pays mobile phlebotomists a mileage reimbursement for driving to and from patients, but fails to pay a proper minimum wages and overtime for the time spent driving, making patient visits, and dropping off samples for shipment to Stover Diagnostics’ laboratory in Missouri. Instead of paying proper minimum wages and overtime wages as required by federal law, the lawsuit alleges that Stover Diagnostics improperly pays mobile phlebotomists as independent contractors even though their job responsibilities make them employees.
