Tim Miles focuses his practice on class action litigation, including cases involving violations of federal securities law, as well as shareholder derivative litigation. Tim has also been involved in cases involving breaches of fiduciary duty in transactional litigation in connection with the merger or acquisition of public corporations.
For fifteen years, Tim has been involved in some of the firm’s most significant cases in these practice areas. Tim has played pivotal roles in the certification of the class allegations and, ultimately, in seeking Court approval of the settlements of these cases. For example, Tim served on the firm’s litigation team in In re Goody’s Family Clothing, Inc. Shareholder Litigation, Master Docket No. 165357-2 (Chancery Ct., Knox Cty, Tenn.) – a case in which the firm was appointed lead counsel. After multiple hearings on motions for injunctive relief, a settlement was reached that provided the Goody’s shareholders with a nearly $53 million increase over the initial offer. Additionally, Tim played a significant role in In re Biopure Corporation Derivative Litigation, Master Docket No. 1:04-cv-10177-NG (D. Mass.), litigation that resulted in a settlement where significant corporate governance reforms were obtained.
